Age verification for online alcohol sales and delivery in Australia

If you sell alcohol online in Australia, the age check is no longer something you can leave to the courier. New South Wales now regulates how age must be verified both when the order is placed and when it is handed over, and the other states are heading the same way. This guide explains what the NSW rules require, what has to happen at the door, and where facial age checks fit in a compliant flow. It is general information. What NSW requires when the order is placed

For same-day alcohol delivery, NSW requires the provider to verify that the purchaser is 18 or over at the point of sale, using one of three methods:

• An accredited digital identity service provider confirms the purchaser is 18 or over.
• AI-based verification of an acceptable proof-of-age document. The purchaser presents an ID and technology verifies it, rather than a human eyeballing an upload.
• A declaration to show ID at the door. The purchaser states that they, or the adult they nominate, will present a proof-of-age document at delivery.

Two things are worth noticing. Self-declaration alone (“yes, I am over 18”) is not on the list. And the accredited digital identity route is one option, not the only one: the rules explicitly contemplate AI-based document verification as an alternative pathway.

What has to happen at the door

Verification does not end at checkout. At handover, NSW requires the delivery person to check acceptable ID whenever the recipient could reasonably be mistaken for under 25. For recipients who clearly look older, the delivery person may instead take a signed declaration that the person is 18 or over. Alcohol cannot be left unattended, delivered to an intoxicated person, or handed to anyone under 18.

These obligations sit with the delivery provider and its staff as well as the licensee, so marketplaces and courier platforms are inside the net, not just the bottle shop.

What about the other states?

Liquor law is state by state, and the details differ: requirements in Victoria, Queensland and elsewhere are not identical to NSW. But the direction across the country, and across online-safety regulation generally, is consistent: regulators increasingly expect businesses to prove the age, not just ask for it. If you deliver into multiple states, check each regulator’s current requirements rather than assuming the NSW position applies everywhere.

A quick word on vapes

If your plan involves selling vapes online: since 1 July 2024, vapes can only be sold by pharmacies in Australia. Online and retail sales by anyone else are illegal nationwide, so for general retailers there is no compliant online vape channel to age-gate.

Where facial age checks fit

• Liveness detection. Confirms the selfie comes from a real, present person, not a photo of a photo.
• At the door. The same age-estimation call inside a driver app gives delivery staff an objective signal for the “could they be under 25?” judgement, and a record that the check was done.

To be clear about the boundaries: eaglecheck analyses faces. It does not verify the authenticity of identity documents, and it is not an accredited digital identity provider under the Australian Government scheme. Whether a particular flow satisfies your licence conditions is a question for your regulator; what we provide is the face analysis inside it. A practical starting checklist

• Confirm which rules apply to you: your state’s liquor law, your licence conditions, and whether same-day delivery rules capture your model.
• Design both checks: one at purchase, one at handover. NSW requires both.
• Pick your purchase-time pathway: accredited digital ID, AI-assisted document verification, or declaration plus ID at the door.
• Equip your drivers: the under-25 judgement call is where compliance breaks down in practice. Give staff a tool, not just a policy.
• Keep records. A log of the checks you ran is your evidence that the system works.
